    1. What this service is

    Floatback ("the app") is a self-guided wellness and personal development tool operated by Wired Different Labs LLC, a Pennsylvania limited liability company, doing business as Floatback ("we", "us", "our"). In these terms, "you" and "your" refer to the person accessing or using the app. By accessing or using the app, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the app.

    The app uses techniques informed by the principles of Eye Movement Desensitization and Reprocessing (EMDR) research to help you explore difficult experiences, build internal resources, and work with experiences using self-administered bilateral stimulation.

    The app draws on EMDR concepts and bilateral stimulation research, but it does not implement the full clinical EMDR protocol, which requires a trained therapist. Think of the relationship the way a meditation app like Headspace relates to clinical Mindfulness-Based Stress Reduction (MBSR): informed by the research, accessible on your own, but not the clinical program itself.

    2. This is not therapy

    Floatback is a coaching tool, not a therapeutic service. It does not provide medical advice, clinical diagnosis, or treatment. It is not a substitute for professional mental health care. The creators of this app are not licensed therapists or healthcare providers.

    Using this app does not create a therapist-client, doctor-patient, or any other professional-client relationship between you and Floatback, its creators, or its AI companion.

    3. The AI companion

    Floatback includes an AI-powered conversational companion. You should understand that:

    • The companion is a software program, not a person, not a therapist, and not a substitute for human connection or professional support.
    • AI systems can produce responses that are inaccurate, incomplete, or inappropriate. Do not treat the companion's reflections as clinical assessments or factual diagnoses.
    • The companion may occasionally misread your emotional state, offer a reflection that doesn't fit, or miss important context. You are always the authority on your own experience.
    • Conversations with the companion are not confidential in the way therapy sessions are. See our Privacy Policy for how your data is stored and protected.

    4. No efficacy warranties

    We make no warranties, claims, or representations regarding the efficacy of this app compared to in-person EMDR therapy, any other format of EMDR delivery, or any other therapeutic approach. Individual experiences vary. The techniques in this app may be helpful for some people and not for others.

    5. No professional endorsement

    Floatback is not endorsed, created, developed, or tested by EMDRIA (the EMDR International Association) or any other professional EMDR organization, licensing body, or clinical institution. Our use of EMDR-informed principles does not imply any affiliation with or approval by these organizations.

    6. Suitability

    By using Floatback, you acknowledge that:

    • This app may not be the appropriate solution for your specific needs.
    • Self-guided work with difficult experiences is not suitable for everyone, particularly those with complex trauma, active dissociative disorders, or acute psychiatric conditions.
    • This app may not be a complete substitute for face-to-face therapy delivered by a trained professional.
    • If you are unsure whether self-guided work is appropriate for you, consult a mental health professional before using this app.

    7. Not for clinical, diagnostic, or legal use

    Floatback is not intended for clinical diagnosis, and its outputs (including experience maps, distress ratings, and companion reflections) should not be used as evidence or documentation for any official purpose, including but not limited to: court-ordered counseling, legal proceedings, insurance claims, disability assessments, or medical treatment decisions.

    8. Crisis and emergency situations

    THIS APP IS NOT DESIGNED FOR USE IN CASES WHERE YOUR LIFE OR SAFETY, OR THE LIFE OR SAFETY OF OTHERS, IS AT IMMEDIATE RISK.

    If you are experiencing suicidal thoughts, thoughts of harming yourself or others, or any other emergency, please immediately:

    • Call 988 (Suicide & Crisis Lifeline, available 24/7)
    • Text HOME to 741741 (Crisis Text Line)
    • Call your local emergency number (911 in the US)
    • Go to your nearest emergency room

    This app is also not appropriate as your only resource if you are experiencing severe or worsening mental health symptoms, active substance abuse crisis, symptoms of psychosis, or severe dissociation.

    9. Your responsibility

    You are responsible for your own well-being when using this app. By using Floatback, you acknowledge and agree that:

    • You understand this is a wellness and coaching tool, not clinical treatment.
    • You will stop using the app and seek professional help if you experience distress that feels overwhelming or beyond what you can manage on your own.
    • You will not rely on this app as your sole source of mental health support.
    • You are at least 18 years of age.
    • You take full responsibility for any decisions you make based on your experience with the app.

    10. Beta service

    Floatback is currently in beta. This means the app is under active development, and you may encounter bugs, incomplete features, or unexpected behavior. We provide the beta on an invitation-only basis and make no guarantees about availability, uptime, or data persistence during the beta period.

    Your feedback during beta is valuable and helps shape the app. By participating, you understand that features may change significantly and that the service may be interrupted or discontinued without notice.

    11. Subscriptions, billing, and refunds

    Some features of Floatback are offered through paid plans. If you choose to subscribe or purchase a one-time plan, the following terms apply.

    • Plans we offer. Monthly subscription, annual subscription, and a one-time "lifetime" plan. Current pricing is shown on the pricing page in the app at the time of purchase.
    • Free trial. New accounts include a free-trial period (currently 7 days unless we say otherwise on the pricing page). No payment method is required during the trial, and nothing is charged unless you choose a plan. Paid plans begin billing at the time of purchase.
    • Auto-renewal. Subscription plans renew automatically at the end of each billing period (monthly or yearly) at the then-current price for that plan, until you cancel. Lifetime plans are a one-time charge, with no renewal.
    • How to cancel. You can cancel your subscription at any time from the billing area in Settings, which opens Stripe's secure customer portal. Cancellation takes effect at the end of the current billing period. You keep access until then.
    • Cancellation as part of account deletion. If instead you delete your account from Settings while a paid subscription is active, we cancel the subscription at Stripe immediately on your behalf and delete your customer record at Stripe. You won't be billed again. We do not automatically refund the unused portion of the current billing period. If you would like a prorated refund, contact us before deleting your account or use the feedback form afterward.
    • Refunds. Charges are generally non-refundable once a billing period has started. We may, at our discretion, offer a prorated or full refund, for example if you were charged in error or experienced a service issue we couldn't resolve. To request a refund, use the feedback form in the app.
    • Founding-member and beta cohorts. If you joined during a private beta or founding-member window, any discount we promised to that cohort (for example, a percentage off for life) is honored as long as you keep an unbroken subscription. If your subscription lapses, the discount may not be available when you re-subscribe. We'll be clear about that on the pricing page if it applies to you.
    • Promo codes and discounts. Where promo codes are accepted, the discount applies only to the period stated with the code. Discounts cannot be combined with the founding-member discount above.
    • Payment processor. All payments are processed by Stripe. We never see or store your card number, full payment method details, or full billing address; those are held by Stripe. See our Privacy Policy for what we receive from Stripe.
    • Failed payments. If a renewal payment fails, we'll email you and Stripe will retry per its standard schedule. If we still can't collect after the retry window, your subscription will pause or end and you'll lose access to paid features until payment succeeds.
    • Taxes. Prices shown may not include applicable sales tax, VAT, or other taxes, which Stripe may add at checkout based on your location.
    • Price changes. We may change pricing for new billing periods. We'll notify subscribers in advance of a renewal that will be charged at a new price, and you can cancel before the change takes effect.

    12. Intellectual property

    The app and its original content, features, and functionality (including the text, graphics, user interface, audio, video, editorial content, scripts, and software, collectively the "Content") are and will remain the proprietary property of Wired Different Labs LLC and its licensors, and are protected by copyright, trademark, and other intellectual property laws.

    You may use the Content only as needed to use the app as intended. You agree not to copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of any part of the app, except to the extent such restrictions are prohibited by applicable law.

    "Floatback" and "Wired Different Labs" and associated logos are trademarks of Wired Different Labs LLC. You are not granted any right or license to use these marks, and any unauthorized use constitutes a material breach of these terms. You retain ownership of the personal content you create within the app, as described in our Privacy Policy.

    13. Acceptable use and account termination

    You agree not to use the app to:

    • Violate any applicable law or regulation, or infringe the rights of any third party.
    • Attempt to gain unauthorized access to the app, other user accounts, or our systems.
    • Interfere with, disrupt, or overload the app or the infrastructure that supports it.
    • Scrape, harvest, or extract data from the app by automated means.
    • Use the app to impersonate another person, or to submit content you know to be false, misleading, or unlawful.
    • Use the app in any way that could harm minors or other vulnerable individuals.

    We may suspend or terminate your access to the app at any time, with or without notice, if we reasonably believe you have violated these terms, or if we need to do so to protect the app, other users, or ourselves. You may stop using the app at any time by deleting your account from the Settings page.

    14. Third-party content and services

    The app may include links to third-party websites, resources, or services (for example, crisis hotlines, professional directories, or educational material). These are provided for your convenience only. We do not control, endorse, or assume responsibility for any third-party content, products, or services, and your use of them is at your own risk and subject to the third party's terms.

    From time to time we may reference or feature associated services, such as coaching, therapy directories, or other wellness tools. We make no representations or warranties about their quality, qualifications, or suitability, and we will not be liable for any loss or harm arising from your decision to use them.

    15. Limitation of liability

    The app is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, security, or accuracy. To the fullest extent permitted by applicable law, we expressly disclaim all such warranties.

    To the fullest extent permitted by applicable law, Wired Different Labs LLC, its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or relating to your use of or inability to use the app, including but not limited to emotional distress, reliance on the AI companion's responses, or decisions made based on your experience with the app.

    Our aggregate liability arising out of or relating to these terms and your use of the app will not exceed the greater of the total amount you have paid us in the twelve (12) months preceding the claim, or one hundred U.S. dollars (US$100), except where a higher amount is required by applicable law.

    16. Indemnity

    To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Wired Different Labs LLC and its affiliates, officers, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the app; (b) any activity that occurs through your account; (c) your violation of these terms; or (d) your violation of any third-party right, including any intellectual property, privacy, or publicity right.

    17. Your data

    Your privacy matters to us. Please review our Privacy Policy for details on how we collect, store, and protect your data. You can delete your data at any time from the Settings page.

    You retain ownership of the content you create within the app. We do not sell your personal data to third parties.

    18. General provisions

    Governing law. These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these terms or the app will be brought exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.

    Severability. If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

    No waiver. Our failure to enforce any right or provision of these terms will not be considered a waiver of that right or provision.

    Assignment. You may not assign or transfer these terms without our prior written consent. We may assign or transfer these terms in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.

    Entire agreement. These terms, together with our Privacy Policy, constitute the entire agreement between you and Wired Different Labs LLC regarding the app, and supersede any prior agreements.

    Survival. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, indemnity, and this section) will survive termination of these terms.

    19. Changes to these terms

    We may update these terms from time to time. When we make material changes, we will ask you to review and explicitly agree to the updated terms the next time you open the app before you can continue using Floatback. We will notify you of significant changes through the app.
